APOLOGIES AND DECLARATIONS OF INTEREST

139.1 Apologies were received and accepted from Cllr S.A. Shepherd

139.2 Councillor Ellis declared that, as a member of Hambleton District Council, he would reconsider any matters at the district level taking into account all relevant evidence and representations at the district tier.

It was AGREED to adjourn the meeting for up to 15 minutes to take questions or comments through the Chairman from members of the public. All items raised by the public are recorded to enable the council to deal with at the appropriate time. There were 6 members of the public present.

Resident 1 - passed a picture of the trees on Copperclay Walk around all Cllrs and advised he had read the tree report from Bartletts Tree Experts. Wishes to request that if the purple plum is removed then a replacement purple tree should be planted in the same verge but in a better position.

Resident 2 - Highland Court flooding; advised that the flooding is not a ‘one off’ but a regular occurrence during heavy rainfall. When the rain is heavy the force of it goes over the existing gullies, drains and storm drain and tries to get out via the smallest pipe at the bottom of Highland Court, which he feels is a design fault.

Resident 3 - 17 Barns Wray planning application (applicant); he attended the Planning Committee on 19/9/11, heard its recommendation for refusal of the application and has confirmed today with his architects that the application does meet the Planning policies and regulations.

MATTERS ARISING AND CLERK’S PROGRESS REPORT

To note progress on action points from previous minutes (information items only)

a)      Responses/letters sent:

- Further information has been requested from Cross Channel Connections Ltd who would like to hold a Continental Village Market in the Market Place. Any response received will be referred to the next Town Centre Committee on 14/11/11.

- Places have been booked on the SLCC Regional Training Day on 29/9/11 in Thirsk for Cllr Madden, Clerk & Asst Clerk

- NYCC Consultation to Refresh the Sustainable Community Strategy for North Yorkshire; all questionnaires received from members were forwarded to NYCC on 19/8/11

- Approval by ETC to 4Youth Service to run a 'Fun in the park' session in of the Memorial Park on Wednesday 31st August from 1 to 4pm subject to all advertising being carried out by the event co-ordinators

- Approval by ETC to Easingwold Community Church to use the Park and Bandstand in the Memorial Park on Sunday 11 September 2011 to hold a family event

-  Further information has been requested from the member of the public who asked for permission to build dirt jumps for jump bikes and BMX bikes near the Skate Park. The council wishes to see designs and achievable locations as the council are unsure of the area suggested near the Skate Park.

b) Play Park

Ø      Memorial Park Fire Damage - Payment received from Allianz Insurance and replacement equipment ordered. Installation should be completed by end November 2011

Ø      The WREN signage for the Toddler Area has been installed as agreed

Ø      Memorial Park CCTV - order has been placed for new equipment as agreed 11/129. Installation is due for completion by mid-September

Ø      Claypenny Park - the bird mouth fencing along the entrance path has fixed back into place.

Ø      Play Parks Inspection Contract Renewal was renewed with Record RSS; the next inspections will be in October 2011.

Ø      Skate Park - slight lip in the large skate ramp has appeared; RSS Record instructed to repair

c) Footpath Chapel Street to Croft Close (Freemans Slip)

NYCC inspected this path on 17th March 2011. The path has 2 areas where tree roots are lifting up the surface. NYCC don't consider the path to be hazardous but the roots do need attention and therefore NYCC will instigate repairs as soon as possible.

d) Market Place

Easingwold Public Toilets - The Clerk wrote on 17/8/11 to ask HDC to provide a survey report to Easingwold TC stating the condition of the buildings (interior & exterior), electrics and plumbing.

e) Easingwold in Bloom

Ø      The presentation of awards ceremony took take place on Saturday 10/09/11 in the Galtres Centre

Ø      An article of photographs from the presentation ceremony will be forwarded to the Easingwold Advertiser for publication

f) Reports to NYCC Highways

Items reported to NYCC:

Ø      Two bollards missing from the tarmac area in front of Towlers, the Opticians and Co-Op stores. Mrs Charlton has since advised that she is investigating the legal position

Ø      Potholes on Bonneycroft Lane - NYCC advised on 24/8/11 that the area has been inspected and a works order raised to fill some of the potholes. NYCC have submitted a funding request however its condition is not considered dangerous at the moment.

Ø      Leasmires Avenue - see main agenda

Ø      Galtres Drive, standing water - NYCC advised 22/8/11 that they are aware of this issue but do not consider it an emergency and do not have the resources to carry out the repairs

Ø      35-50 Uppleby, resurfacing of footpath - NYCC advised 22/8/11 that they have submitted a funding request however its condition is not considered dangerous at the moment.

g) Parking Issues on Long Street

A meeting is being arranged by NYCC’s Mr G Hind with Sgt J Hunter, NYP Traffic Sgt, Cllrs Shepherd & Madden plus three interested business owners located on Long Street. The meeting is likely to be held w/c 26/9/11 as it has been delayed due to the summer leave period

h) Future Premises of Easingwold Town Council

Renting space in library - NYCC verbally advised indicative annual rental of £1700. This has not been confirmed in writing. NYCC met with stakeholders on 29/7/11

i) Dawnay (Scouts)

The signed lease was returned to Grays Solicitors on 22/6/11. As the deeds for the land cannot be found, Cllr Ellis has agreed to make a statutory declaration to enable the land to be correctly registered for the first time; this is waiting for ‘swearing’ with Cllr Ellis and a local solicitor.

j) NYCC SCTS Easingwold Market Place

Ø      The Clerk advised Mrs Charlton that ETC approved the quick drying paint solution offered rather than the original choice, as recommended by ERWG, which the supplier has specified is for use on steelwork only.

Ø      Bus stop lines on the south side were painted on 5/9/11 - see main agenda

Ø      Listed Building Consent application for the Market Cross (Phase 2) has been approved by HDC. The works are provisionally scheduled to commence on 19/9/11

k) Bird Mouth Fencing Long Street, opposite Police House

The Clerk placed a contract locally to repair the damaged section of fencing for £418 + VAT, as instructed by F&GP 27/06/11. The contractor is awaiting confirmation from NYCC Highways that he has been added to the NYCC approved contractor list to work in the highway. Further quotes have been requested from contactors on NYCC’s approved list.

l) Galtres Sports Centre; Proposed Legal Charge

The Clerk acknowledged the letter from the GMC stating they would pay all legal costs and included a copy of Grays email to ETC dated 28/7/11. Grays have confirmed the invoice has been paid in full.

m) Late Night Bus Service to Easingwold

The letter from Cllr Tanfield was sent to a local bus company on 9/8/11 by the Clerk’s Office. The bus company are working on comments on the viability of a commercial service.

n) Trees

Copperclay Walk - TPO’s planning application for trees outside property numbers 6 (elm & removal of smaller trees) & 10 (silver birch) was withdrawn on 17/8/11

All tree issues were discussed at the last Open Spaces Committee, held 19/9/11; see main agenda Committee Reports

o) Roundabout Sponsorship, A19 (near Hawkhills)

The Clerk has informed NYCC Highways that ETC approved the request and the intention for ETC to submit a license request. Also to confirm that NYCC have no concerns e.g. utilities located under the roundabout, which would preclude any sponsorship. The potential sponsor has been sent by the Clerk the NYCC list of requirements for roundabout sponsorship.

p) Newsletter

The agreed newsletter was published on the website, placed on the notice board and in the library w/e 19/8/11

q) Events in the Market Place granted under the delegated powers of the Chairman & Clerk

MATTERS ARISING:

Ø      Easingwold in Bloom 2011 picture cards initiative. It was AGREED to add to October’s agenda. In the interim the Clerk will discuss the idea with the Tourist Information Centre and obtain a printing quote.

Correspondence for Decision

143.1 Member of the Public, request to hold a Diamond Jubilee service in the Memorial Park 3 June 2012; it was AGREED to approve this request

143.2  Easingwold WI, request to erect 2 plaques in front of the trees that the WI have planted, one tree is situated on the grass opposite G H Smiths Printers and the other is on the grass opposite St John the Baptist and All Saints Church; it was AGREED to approve the plaque for the Market Green on the understanding that the post and plaque height should not be more than 8” from the ground to the top of the plaque. The rowan tree is not opposite the church but the first tree on the right as you exit the Police House car park which is owned and managed by NYCC. The Clerk should advise the WI that NYCC’s permission will be required.

143.3 Easingwold Lions, request to hold Carols in the Market Place event on Saturday 17/12/11 on the car park side; it was AGREED to approve this request

143.4 Easingwold School Youth Council, request for Cllrs to meet with them to discuss face to face youth issues; it was AGREED that this is a good idea which has been done before. Cllrs Madden and Snook volunteered to meet with the Youth Council; the Clerk should obtain the date & time of the next meeting and the formal agenda.

NYCC SCTS EASINGWOLD MARKET PLACE

144.1 It was noted that NYCC planned Phase 2 works to the Market Cross had started on 19/9/11 with an expected completion date including site clearance by 7/10/11.

144.2 The request from NYCC regarding bus stop lines and wording dated 13/9/11 was considered. It was AGREED to give permission to NYCC re-lay an area of cobbles in a concrete mortar which the paint will stick to and to paint on the bus stop lettering in the bus stop on the south side of the Market Place. Approval was given for ETC to pay NYCC for the re-laying of the cobbles up to a maximum cost of £500.00.

144.3 To consider contingency plan if Phase 2 works overrun as the Annual Fair is expected to arrive on Monday 24/10/11 for one week and the Friday Market should relocate to the Market Cross site.

The Clerk advised the fair is scheduled to arrive on Tuesday 18/10/11 and operate Thursday-Monday (excluding Sunday), moving out on Tuesday 25/10/11. As NYCC expect to complete Phase 2 works by 7/10/11, it was AGREED no contingency plan is necessary. The fair will operate as usual from the car park side and the Friday Market will re-locate to the Market Cross side of the Market Place for this week only.

EASINGWOLD PUBLIC TOILETS

145.1 The email from HDC dated 19/9/11 was considered. The Clerk advised that ETC’s request to HDC to provide a survey report to Easingwold TC stating the condition of the buildings (interior & exterior), electrics and plumbing was sent on 17/8/11, along with the report submitted to full council by the Toilets Sub Committee, to ensure that HDC are fully aware of ETC’s plans and concerns.

It was AGREED to do the following:

a)      Request HDC to provide ETC with a valuation of the W.C’s for insurance estimate purposes

b)      To advise HDC it is an aspiration to the council to take over the W.C’s in Easingwold but it is not definitely decided

c)      The decision by ETC to take over the W.C’s is partly subject to the outcome of HDC’s Cabinet report on 18/10/11 which should state whether HDC are retaining Northallerton W.C’s or not

d)      The Clerk should advertise for expressions of interest from the public in running the W.C’s on a contract with ETC; Cllr Snook to supply draft to the Clerk

e)      The Clerk should write to HDC stating that the Town Council will make its decision when it receives a), c), the survey report as requested from HDC on 17/8/11 and has information to gauge interest from the public as detailed at d).

145.2 To decide which Solicitor should be appointed to deal with the transfer of the ownership and management of the public toilets. It was AGREED to carry forward this item to the next meeting.

NYCC; FUTURE OF EASINGWOLD LIBRARY

146.1 To receive an update from the Library Steering Working Group (LSWG); as Cllr Shepherd was not at the meeting this item should be carried forward.

146.2 To consider the way forward- no matters raised.

 PARKING ISSUES ON LONG STREET

147.1 To note that the meeting of stakeholders to consider the way forward will be held w/c 26/9/11.

The Clerk confirmed that she had requested Mr Hind arrange the meeting but no confirmation of date had yet been received.

147.2 The letter regarding inconsiderate parking in front of the terraces between Chapel Street and Little Lane from a resident on Long Street was received and considered. It was AGREED that displacement of parked vehicles is the issue against having double yellow lines in this area. The concerns of the resident were noted but ETC wish to see the current arrangements unchanged. Any action to introduce parking restrictions in this location will just move the problem elsewhere. The council did not agree that emergency vehicles would struggle to access properties in the location as if there was an emergency they would access the property via the grass verge.

 FUTURE PREMISES FOR EASINGWOLD TOWN COUNCIL

148.1 It was noted that the new licence from NY Police had not yet been received.

148.2 To consider any information from NYCC regarding the potential of renting office space in Easingwold library (if received) - none received.

148.3 It was AGREED to carry forward this item to the next meeting.

 TREES

149.1 Tree work at Copperclay Walk subject to Tree Preservation Order 1997/12; the report from Bartletts Tree Experts was received.

149.2 The recommendation from the Open Spaces Committee was received as follows:

It was AGREED to approve Bartletts quote to carry out the following work on Copperclay Walk;

T1 Purple Leafed Cherry Plum; dismantle and remove to ground level due to wood decay fungi, over-development of the location affecting the development of the specimen Hornbeam.

S1 Stump removal by grinding to a depth of approximately 200mm below existing ground level, all created arisings to be retained on site.

T2 Ornamental Cherry poorly located tree affecting the use of the footpath. Incompatible graft union and long-term issues relating to re growth issues. Dismantle and remove to ground level.

S2 Stump removal by grinding to a depth of approximately 200mm below existing ground level, all created arisings to be retained on site.

T3 Hornbeam crown clean in line with BS3998 Recommendations for Tree Works and deadwood. Structural prune to re-address the balance and improve structure and form. Crown lift the canopy to 3metres above ground level to improve sight lines and balance.

T4 Crab Apple dismantle and remove to ground level to allow for the development of the Hornbeam.

S3 Stump removal by grinding to a depth of approximately 200mm below existing ground level, all created arisings to be retained on site.

For the Sum of £512.00 plus VAT

 

It was AGREED to approve Bartletts quote to crown reduce the canopy of the Silver Birch  outside number 10 Copperclay Walk to reduce nuisance and light issues to the dwelling.

For the Sum of £ 64.00 plus VAT

 

Full council AGREED to ratify the above and authorise the works including the application to HDC for the necessary permissions for a total cost of £606.00 +VAT. The residents’ concerns were all taken into account and it was AGREED that if the purple plum was removed it should be replaced with a similar coloured tree, with little or no lateral spread, in the verge at a location recommended by the tree experts. The Clerk should obtain quotations and options of tree. The two horse chestnuts at the site had also been inspected but not recommended for removal. They are fine at the moment but should be monitored as this variety is susceptible to problems and one may be showing very early signs of deterioration.

REMOVAL OF HDC’S BOTTLE BANKS FROM THE GALTRES CENTRE CAR PARK

It was confirmed that the bottle banks had been removed by HDC three weeks ago. HDC have requested The Galtres Centre to relocate them to a different area in the car park and this will be discussed at their next meeting on 6/10/11. It was AGREED to carry forward this item to the next meeting.

DRAINAGE ISSUES AT HIGHLAND COURT, EASINGWOLD

151.1 To receive two proposals from Cllr Madden to:

a) Request that NYCC Highways Authority investigate the surface water drainage at the lowest point (opposite property no 12) with a view to improvements to assist with the rapid drainage of surface water during heavy rainfall

b) Request that Yorkshire Water investigate the surface water drainage system which receives water from Highland Court to ensure that the surface water sewer is of sufficient capacity to prevent the build up of flood water

It was RESOLVED to accept both proposals above. Cllr Madden offered to draft letters to the authorities for the Clerk to send.

151.2 County Cllr Sowray advised that NYCC officer, Mr C Jackson was aware of this issue and he would speak with him to try to move it forward.

BIRD MOUTH FENCING, LONG STREET

152.1 To consider whether to appoint a different contractor from NYCC’s list of approved contractors to work in the Highway. It was AGREED to accept the first quote received from an NYCC approved contractor providing the value does not exceed the price already agreed, to ensure the works are done as soon as possible.

TAXI STANDS IN HAMBLETON DISTRICT

154.1 The consultation letter was received from HDC and it was AGREED that a taxi rank was not necessary in Easingwold

154.2 The response sent to HDC’s Environmental Health Officer by an Easingwold resident was noted and supported.

ANTI SOCIAL BEHAVIOUR, GALTRES DRIVE

Cllr Claire Harrison advised she had written to the Police and Housing Associations but had not received any replies so far, but would chase up. Incidents have reduced recently possibly due to the changing weather. It was AGREED to carry forward this item to the next meeting.

LEASMIRES AVENUE, BLOCKED RAIN GULLIES

The confirmation from NYCC that the appointed contractor will be undertaking remedial works at the contractors own expense was noted.

EMERGENCY EXPENDITURE

To note and approve any emergency expenditure actioned by the Clerk since the last meeting.

Ø      £5.25 repairs to the roof of the multi-play unit in the Toddler Area in the Memorial Park, which is believed to be damage caused by high winds.

It was AGREED to approve the above.

COMMITTEE REPORTS

158.1 Cllr Readman advised that the Open Spaces Committee met on 19/9/11, the highlights are as follows:

Ø      There will be an allotments site visit due to a complaint regarding unruly hedges; committee members will report back

Ø      Easingwold Lions have offered to work in partnership with the council towards donating funds for new trees

Ø      Trees; many queries on problems with trees in Uppleby, the Market Green, and those already reported on Copperclay Walk

Ø      Fly tipping on Millfields/Claypenny rough cut area will be monitored

Ø      Permission was granted for a larger scale orienteering event and race in Easingwold in April 2012

Ø      Mallison Hill Wood; quotes to be obtained for all growth at the rear of the properties on Mallison Hill Drive to be pushed back by 2 metres and permanently removed to ensure this work is not required again in the future. The work will be carried out in 2 phases. Phase 1 will be from the rear of number 14 to Oulston Road; this work should be carried out in the winter. Phase 2 will be carried out in the next financial year.

Ø      The purchase of a new lawnmower was agreed at a cost of £540+VAT

 

159.2 Any other committee reports

Cllr Readman advised that as the council representative on United Charities she attended their recent meeting. It was noted that due to the large amount of the charities funds being spent on essential tree maintenance, donations to other organisations are lower this year.

Cllr Gallon advised she had attended an NYCC Highways meeting on 5/9/11 to discuss the winter road damage on the A19. All members had received a copy of the meeting notes already. Repair works will be carried out on the A19 stretch from the Thircon roundabout (Thirsk) to Shipton and disruption, whilst inevitable, will be kept to a minimum by night time working (7pm-7am approx closures). The works will be undertaken from mid October and should be completed by mid December, depending on weather conditions.

TOWN REPAIRS AND MAINTENANCE

There is a dead tree, possible eucalyptus, on Chase Garth Road near the Scout Hut. The Clerk advised that this has already been reported to HDC for investigation, as they own this area of land.

It was AGREED to go in to public session to hear views from members of the public.

Resident 1:Applicant

Explained to members of the council and public that the plans have been amended to take in to consideration neighbours views. The proposed dwelling is now of a similar size to number 19 Barns Wray with a standard double garage. Mr Morgan is over whelmed at the number of objections on the planning portal as 12 of the objectors are not even residents of Barns Wray. It was explained that Mr Ken Wood the Architect advised Mr Morgan on all planning aspects ensuring the application meets with all planning requirements.

Resident 2: Strong concerns over losing views from his property, views at present are trees and greenery, if the application goes ahead views from his property will be a large brick wall. The proposed development has not been amended enough, the dwelling is still too large for the site and out of proportion with the plot, and the garage is still a double garage. On a wider issue residents have a concern over garden grabbing; Councillor Ellis explained that garden grabbing is not a reason to refuse an application.

Resident 3: Supports the views and concerns made by resident 2 and also has concerns over losing privacy over his front garden. If this application is approved then what is stopping others wanting to infill spare sites, this could just be the start of new dwelling applications on Barns Wray when the residents just wish to keep it as it is.

 

It was resolved  to close the Public Session and return to the committee

 

A site meeting is planned with Hambleton District Council on 10/10/11; Easingwold Town Council Members will be invited to attend if they wish.

 

 

Council wish to see REFUSED as the dwelling is too large for the size of the site, there is no domestic curtilage and the proposed dwelling is not in keeping with the street scene.

 

This application will be re opened at full council 20/09/11. Recommendation ratified at full council

Outline application for the construction of a mixed use development (business B1 and B2, retail A1,healthcare D1 and leisure D2)

 

It was AGREED to go in to public session to hear views from members of the public.

 

Resident: Concerns over the proximity of the outlined industrial units to the properties on Sandholme Drive (Broadlea)

Concerns over the size of the car park as it states over 180 car parking spaces where as Easingwold Business Park only has 60. Large car parks can bring nuisance behaviour especially on an evening.

The units also need to be set back a little away from Stillington Road; other industrial sites are screened with hedging and greenery.  Visitors and residents of the town do not wish to see industrial units when approaching Easingwold.

 

It was resolved  to close the Public Session and return to the committee

 

A site meeting is planned with Hambleton District Council on 10/10/11; Easingwold Town Council Members will be invited to attend if they wish.

 

Wish to see APPROVED providing the following comments are taken in to consideration;

 

Request for a recycle centre on site, this will help free up car parking spaces at the Galtres Centre.

Larger buffer between the houses on Sandholme Drive (BroadLea) with more screening.

Concerns over the volume of traffic this will bring to the Long Street junction.

We wish to encourage smaller scale manufacturing units rather than retail units on the site and wish to see the materials used is in keeping with the surrounding area.

·          The Town Council wish to see a reduction in the number of 4 bedroom dwellings and an increase in 3 bedroom dwellings.  It recommends a wider variety of housing size and type. It notes there are no single storey dwellings proposed on the site, which are in high demand in Easingwold.
